1. Definitions
- "Kithly", "we", "us", "our" — refers to the company operating the Kithly family transition education programmes, based at 133 Beach Road, Nong Prue, Bang Lamung, Chonburi 20150, Thailand.
- "User", "you", "your" — refers to any individual who accesses our website, makes an enquiry, or enrols in a programme.
- "Programme" — refers to any Kithly workshop, toolkit, or series, including the Keeping Connected Workshop, the Shared Arrangements Toolkit, and the Comprehensive Preparation Series.
- "Materials" — refers to worksheets, templates, session notes, and other educational content provided as part of a Programme.
- "Agreement" — refers to these Terms & Conditions, together with any enrolment confirmation issued to you.
2. Acceptance of Terms
By enrolling in a Programme or accessing our Materials, you confirm that:
- You are at least 18 years of age.
- You have the legal capacity to enter into this Agreement.
- You have read and understood these terms.
3. Service Description
Kithly provides educational workshops, organisational toolkits, and a combined preparation series for adults navigating family transitions. All Programmes are educational and administrative in nature only. Kithly does not provide legal, financial, psychological, or clinical advice. Kithly does not represent participants in any professional or legal capacity. Participation in a Kithly Programme does not create any advisory, fiduciary, or professional relationship.
Programmes are delivered in the English language and are primarily available in person at our Chonburi location. Remote or alternative arrangements may be discussed on request.
4. Enrolment and Payment
Enrolment is confirmed upon receipt of full payment. All prices are stated in Thai Baht (฿) and are as follows:
- Keeping Connected Workshop: ฿3,900 per participant
- Shared Arrangements Toolkit: ฿13,200 per household
- Comprehensive Preparation Series: ฿31,500 per household
Refunds: If you cancel your enrolment more than 7 days before the scheduled start of a workshop or series, we will refund the full amount paid less an administrative fee of ฿500. Cancellations with less than 7 days' notice are non-refundable. Toolkit purchases are non-refundable once access has been granted. We reserve the right to cancel or reschedule a session with reasonable notice, in which case a full refund will be offered.
5. User Responsibilities
By participating in a Programme, you agree to:
- Treat facilitators and other participants with respect.
- Not record, photograph, or reproduce session content without prior written consent.
- Use Materials for personal, household purposes only — not for commercial redistribution.
- Not misrepresent our Programmes as providing legal, financial, or professional advice.
6. Intellectual Property
All workshop content, templates, checklists, session guides, and other Materials are the intellectual property of Kithly. Upon enrolment, you are granted a limited, non-exclusive, non-transferable licence to use the Materials for your personal and household purposes. You may not reproduce, sell, distribute, or adapt the Materials without prior written consent from Kithly.
7. Disclaimers
Kithly's Programmes are provided as educational resources. We make no representation that participation in any Programme will produce a particular outcome in your family situation, legal proceedings, professional consultation, or personal circumstances. All Materials are provided for informational purposes only.
Nothing in our Programmes constitutes legal, financial, psychological, medical, or professional advice. You should always seek qualified professional guidance for matters requiring it.
8. Limitation of Liability
To the fullest extent permitted by Thai law, Kithly's liability to you in connection with any Programme or Materials shall not exceed the amount you paid for that Programme. Kithly shall not be liable for any indirect, consequential, or incidental losses arising from your use of our Programmes or Materials.
Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence.
9. Indemnification
You agree to indemnify and hold harmless Kithly, its staff, and facilitators from any claims, losses, or costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of Materials, or your conduct during a Programme.
10. Termination
Either party may end a participation arrangement at any time. If Kithly terminates your participation due to a breach of these terms, no refund will be due. If Kithly cancels a Programme for operational reasons, a full refund will be issued. Sections 6, 7, 8, and 9 survive termination.
11. Governing Law and Disputes
These terms are governed by the laws of Thailand. Any disputes arising from these terms or your participation in a Kithly Programme shall first be referred to informal resolution by contacting us at [email protected]. If informal resolution is not possible within 30 days, disputes shall be subject to the jurisdiction of the courts of Chonburi Province, Thailand.
12. General Provisions
- Entire Agreement: These Terms, together with your enrolment confirmation, constitute the entire agreement between you and Kithly.
- Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without Kithly's prior written consent.
13. Changes to These Terms
Kithly may update these Terms from time to time. Updated Terms will be posted to our website with a revised effective date. Your continued participation in a Programme following any update constitutes acceptance of the revised Terms.
